Take fresh call on CCI probe against Flipkart: SC to NCLAT

NEW DELHI: The Supreme Court connected Tuesday asked the National Company Law Appellate Tribunal (NCLAT) to determine afresh whether it is indispensable for the Competition Commission of India (CCI) to probe a 2018 ailment accusing e-commerce large Flipkart of maltreatment of its marketplace ascendant position.Taking up an entreaty by Flipkart against a March 4, 2020, NCLAT order, a three-judge seat headed by CJI Surya Kant said it would beryllium due if the tribunal decided afresh whether a probe was indispensable to beryllium conducted successful a 2018 complaint, which accused the e-commerce level of resorting to predatory pricing.Fair-trade regulator CCI had rejected the ailment by All India Online Vendors Association. However, connected appeal, NCLAT had asked CCI to behaviour a probe connected the complaint. In Dec 2020, SC had stayed the NCLAT order.
